The agreement in brief

The space and the term

You rent a specific space — indoor or outdoor, at the yard located at 2485 County Road 37, Omaha, NE — to store one described rig (RV/camper, boat, jet ski or enclosed trailer). The term starts on your arrival date and ends on the removal date on your agreement. Winter seasonal terms run October through April. The landlord arranges placing and moving rigs within the yard and may ask you to relocate to another space to fit other tenants.

Rent and payment

Rent is a flat monthly rate for the space you reserve. There is no deposit and no setup fee. Payment is set up through PayPal after your space is confirmed. A $25 charge applies to any dishonored or returned payment, as additional rent. Extra services you request — for example moving a rig in or out before the stated removal date — may carry additional fees.

Insurance you must carry

You must keep your own insurance on the stored rig and its contents — fire and extended coverage with theft, vandalism and malicious-mischief protection for the full replacement cost. A current declarations page showing that coverage is provided with your signed agreement. The landlord does not carry insurance on your property.

Release of liability — stored at your risk

Your property is placed in the space at your sole risk. The landlord, its agents and employees are not liable for any loss, damage, injury or death to you or your property arising from the use of the space or premises, from any cause — including theft, water, fire, rodents, animals or weather. The landlord makes no representation that your property will be safely kept or secure against theft or the elements. This release is a bargained-for condition of the rent; without it, the rent would be higher. If you carry insurance, your insurer waives any right of subrogation against the landlord for the released liabilities.

Indemnity

You agree to hold the landlord harmless from, and to defend the landlord against, any claims, damages, attorney's fees and costs arising out of your use or occupancy of the space.

Use rules

The space is for personal storage only. No operating a business from it, no human or animal occupancy, no trash, and no welding, flammable, explosive or otherwise hazardous materials. Nothing that violates any law or government requirement, and nothing that creates a nuisance. You may not sublet or assign the space without the landlord's consent.

Access and inspection

Property access is available any time outside the 10 pm–7 am quiet hours. The landlord may require an inspection of the stored items on 48 hours' notice as a condition of continued tenancy, and may enter a space without notice if a hazardous condition or emergency is believed to exist. If you are in default on rent or charges, the landlord may deny you access.

Default and the storage lien

Unpaid rent, late fees, labor and other charges create a lien on your stored property under the Nebraska Self-Service Storage Facilities Act. If charges remain unpaid, the landlord sends a notice of default by verified or electronic mail at least 45 days before any sale, stating the amount owed, a payment deadline of at least 10 days, and contact information. At least 7 days before the sale the time, place and terms are advertised in a commercially reasonable manner, and the property may then be sold to satisfy the lien. You may name an alternate contact to also receive these notices.

Move-out and abandonment

Remove your rig by the removal date on your agreement, weather permitting. If you don't, the landlord may move the rig at your expense to another location and continue to charge storage, or dispose of it as allowed by law. Do not abandon property at the end of the term.

Other terms

Notices may be sent by first-class mail or email to the addresses on your agreement. If the landlord brings legal action for a breach, you pay the landlord's reasonable costs and attorney's fees. You accept the space in good condition.
